COLUMBUS, Ohio (AP) ' Ohio is poised to end its nearly six-month break in the use of capital punishment by executing a man who fatally shot his three sons while they slept in 1982, shortly after his wife filed for divorce.
State and federal courts have rejected attorneys' arguments that 66-year-old Reginald Brooks of East Cleveland is not mentally competent. The defense also says the government withheld relevant evidence that could have helped Brooks' case.
Prosecutors acknowledge Brooks is mentally ill but dispute that he's incompetent and that information was hidden. They say Brooks planned the killings and took revenge on his wife.
Brooks is appealing to the U.S. Supreme Court.
The Ohio Supreme Court on Monday rejected a request to halt the execution. Gov. John Kasich (KAY'-sik) last week refused to grant clemency.
