Next word in Calif. gay marriage case due TuesdayAppeals court set to say if it will rehear panel's rejection of California's gay marriage ban
SAN FRANCISCO (AP) ' The next word in the long-running legal battle over California's voter-approved gay marriage ban is about to come from a federal appeals court in San Francisco.
The 9th Circuit Court of Appeals plans to announce Tuesday if it will reconsider a previous ruling by two of its member judges declaring the ban unconstitutional.
Backers of the ban petitioned the court in February to review the decision that struck down Proposition 8 as a violation of the civil rights of gay and lesbian Californians.
If the appeals court decides to reconsider the case, it would delay a final resolution, which is ultimately expected to come from the U.S. Supreme Court.
