NEW YORK (AP) ' A federal judge has ordered a Russian arms dealer to be moved from solitary confinement in New York City to a prison's general population.
Judge Shira Scheindlin ordered the change Friday for Viktor Bout (boot).
She says she cannot shirk her duty under the Constitution to ensure that Bout is held under appropriate conditions.
Bout has been in solitary confinement at the Metropolitan Correctional Center since he was brought to the United States 15 months ago. Scheindlin said she believed it was an "exaggerated response" to the Bureau of Prisons' concerns about him.
Bout faces a mandatory 25 years in prison at his March 12 sentencing.
A spokeswoman for federal prosecutors declined to comment.
A lawyer for Bout said the ruling recognizes the prison system "is bound by humane considerations."
