Inmate in RI legal battle to be arraignedRI inmate in legal tug-of-war between prosecutors, Chafee to be arraigned in US court
PROVIDENCE, R.I. (AP) ' A Rhode Island inmate at the center of a legal battle between Gov. Lincoln Chafee (CHAY'-fee) and federal prosecutors is set to appear in federal court for the first time.
Jason Pleau (PLEW) is scheduled to be arraigned Wednesday in U.S. District Court in Providence. He is accused of fatally shooting a man outside a bank in 2010.
The prosecution of Pleau has been on hold since June 2011 when Chafee refused to surrender him to federal authorities. Chafee says prosecutors want to try Pleau federally to make the death penalty a possible punishment. Rhode Island does not have capital punishment.
The case was put in the hands of federal authorities this month when a federal appeals panel sided with prosecutors.
Chafee plans to appeal to the U.S. Supreme Court.
