Gemstar Seeks To Block Importation of STBs With Interactive Program Guides

Gemstar logoGemstar-TV Guide International Inc. and its subsidiary, Starsight Telecast Inc., has filed yet another complaint with the International Trade Commission - this time against Pioneer, Scientific Atlanta, EchoStar and SCI Systems Corp., alleging illegal importation of set top boxes containing interactive program guides ("IPGs") which infringe on Gemstar's patents.

Gemstar is bringing these claims under Section 337 of the Tariff Act, which prohibits the importation into the United States of articles that infringe valid U.S. patents. Gemstar and Starsight are seeking an order from the ITC excluding the infringing IPG boxes from importation into the United States and requiring the proposed respondents to immediately cease all sales of those boxes within the United States. Gemstar is also seeking injunctive relief and other damages against the named respondents via separate U.S. federal court actions.


Currently, Gemstar has pending patent infringement suits against Pioneer, Scientific Atlanta and EchoStar in Federal District Courts. SCI Systems Corp. is a supplier of EchoStar's allegedly infringing set top boxes.

As Gemstar-TV Guide has repeatedly stated when bringing any of the raft of lawsuits against alleged violators of their patents, "Gemstar-TV Guide keeps an open licensing policy and has always been ready to offer reasonable licensing terms to accommodate licensee needs," said Jonathan Orlick, senior vice president and deputy general counsel. "However, Gemstar must enforce its intellectual property rights and will pursue all relevant legal processes."
